Declaration of Interest

 

Introduction

 

The Housing Act 1996 imposes limitations on the contractual arrangements which can be entered into with profit making businesses, if a First Garden Cities Homes Board Member, employee or the close relative* of a Board Member or employee is involved as a Director or employee of that business.

 

Any breaches of the act could have serious implications as any contract entered into may be treated as voidable and any payments made or benefits granted recovered.

 

Given the nature of the Association’s activities and to identify any possible conflicts, we require declarations from those seeking work as a contractor.

 

* Guidance on the definition of a close relative

 

No set definition of this term exists for the purposes of the declaration and each case must be judged on its merits. However, a close relative is deemed to be a relative by blood or marriage who is so close to the Board member or employee that there is a real risk that any decision of the Association to grant them a payment or benefit could be influenced by that relationship.

 

Thus, it will normally include a person's spouse, parent, grandparent, child, grandchild (including children and grandchildren born outside of marriage), brother, sister, nephew, niece, uncle and aunt.

 

Technically, the term 'relative' does not include any relationship that is not by blood or marriage, however close. Where such close relationships exist, however, associations are strongly advised to act as though Schedule 1 did in fact apply. This includes, for example, cohabiting relationships between people of different or the same sex.
